Terms and conditions of the PigeonBid.com auction site

§1 General provisions

These terms and conditions (the "Terms and Conditions") set out the rules for the use of the PigeonBid.com online auction service (the "Service").

The website allows registered users ("Users") to list and bid for racing pigeons ("Pigeons") in the form of online auctions.

Use of the Service constitutes acceptance of these Terms and Conditions.

§2 Scope of services

The Service provides Users with a technical platform to organise and participate in Pigeon auctions.

The Website only acts as an intermediary and is not a party to the sales contract concluded between Users.

The service is not responsible for the truthfulness and completeness of the information provided in the listings or for the quality, health or suitability of the Pigeons.

§3 Registration and user account

In order to use the Website, it is necessary to create a User account by registering.

The user undertakes to provide true and current data and to keep it up to date.

Each user can only have one account.

§4 Rules for placing auctions

Only racing pigeons may be the subject of an auction.

The Seller is obliged to include a description of the offered Pigeon, including in particular: ring number, vintage, origin and other data relevant to the Buyer.

The seller takes full responsibility for the accuracy of the information contained in the offer.

It is forbidden to exhibit Pigeons that are sick, unfit or in breach of the law, including animal welfare regulations.

§5 Rules for bidding and contract conclusion

Buyers place their purchase bids by bidding on the Website.

The sales contract is concluded when the auction ends and the system accepts the highest bid.

At the end of the auction, the Seller is obliged to contact the Buyer to arrange payment and delivery details.

Payment for the Pigeon is made directly between the Seller and the Buyer. The service does not mediate the transfer of funds.

§6 Commission and fees

The website charges the seller a commission for each successful auction.

At the end of the auction, the Service will invoice the Seller for the commission due.

The amount of the commission is set out in the price list available on the Website.

§7 Responsibility

The Website is not responsible for the non-performance or improper performance of sales contracts concluded between Users.

The Service shall not be liable for non-payment, return of the Pigeons, physical or legal defects in the object of sale or any damage caused between Users.

The service is solely responsible for the correct functioning of the technical platform.

§8 Complaints

Complaints related to the functioning of the Service may be submitted by e-mail to the address indicated by the Operator.

Complaints will be processed within 14 working days.

Disputes between Users shall be resolved amicably. In case of disagreement, the common court according to the seat of the Operator shall be competent.

§9 Scope of action

The service operates worldwide.

Users are obliged to comply with the laws in force in the country in which they reside or have their registered office, particularly with regard to the marketing of animals.

§10 Protection of personal data

Users' personal data is processed in accordance with the law, including the RODO Regulation.

The administrator of the personal data is the Operator of the Website.

Detailed data processing rules are set out in the Privacy Policy available on the Website.

§11 Final provisions

The Operator reserves the right to amend the Terms and Conditions. Users will be informed of any change well in advance.

In matters not covered by these Rules, the provisions of Polish law shall apply.

The Regulations shall enter into force on the date of their publication on the Website.
